What is the signature of a lawyer worth? By Geniusofdespair

The form to register the ECO says  that by signing it, you certify the "organization is complete, true and correct." Here is what certify means: to say officially that something is true, correct, or genuine
My post yesterday got some annoying responses probably from the Bell Campaign, here is part of one:
As much as we all might dislike the Bells, I am not sure they have not done anything wrong with their ECO.
In my book, when I sign something it is true. If you state something in a legal form submitted to a government entity it had better be true. When they stated on the form that the ECO would be used for COUNTY races and then used it for the HOMESTEAD race it  became a lie, they are diverting the money. The contributors have a right to know where the money is going. Wendy Lobos knows when she signs her name it should be true, she is an attorney.  Why is lying on LEGAL forms okay to some of you? Wendy knows the money is being diverted. She allowed it to happen.

Opps, I have to offer a retraction. This is hereby retracted with caveats and so is my other post, I need the additional records dated prior to September 2nd:

Juan-Carlos “J.C.” Planas

I represent the ECO, “Good Government Now”, which was the subject of your post earlier today.
I was quite concerned because I specifically remember filing the paperwork with the City of Homestead notifying them that this ECO would be conducting electioneering in that City.
When I called the City Clerk today, I was informed that yes, they did receive our paperwork but because the forms were in a different format, they could not post them on the web.  They had checked with the Miami-Dade Elections Department when they received it and Miami-Dade verified that all that was needed was for the ECO to file courtesy copies with Homestead to be in compliance.  Whether or not the section of the Organizational Papers are physically amended to reflect each City is irrelevant as long as the papers are sent to the Homestead City Clerk.  Accordingly, this ECO is in compliance with the law.
I strongly suggest you issue an immediate retraction to your blog post as it is grossly incorrect in both the facts and the law.

Me: Overkill to be sure.
I don't think IT IS GROSSLY INCORRECT and I never said it wasn't in compliance with the law. I said money was diverted, which it was. The forms are what they are. If we are given incorrect information on a form because it is a "Courtesy" or can't be posted,  it is a mistake on both parts not just mine. I just repeat public records if the records are incorrect I need to know. I didn't make them up.  If there are OTHER public records you submitted prior to September 2nd in Homestead please supply them to me.  Also, when did Wendy Lobos give up her role as head of this ECO?  By the way the Homestead Clerk said she was never informed you would be conducting electioneering in that city. You just filed campaign reports with them on October 10th which she says she guesses is enough. - Also JC don't the donors have to be notified?  They gave to an ECO for one candidate and then the candidate/scope was changed. Educate me. When did the change in purpose of the ECO occur? Why wasn't it amended?  Write a blog, I will print it.

Thanks JC

J.C: Don't you also have a ECO operating in Homestead with a different Scope and Jurisdiction too? I guess this is done all the time? I see the Wayne Rosen (Mark Bell supporter) contributions and have heard about 7 fliers ANTI- Porter coming from this ECO.

Is this the same Wendy that married her child's fathers brother? Is this the same Wendy that approved grants for the City of Florida City when she was not yet a citizen of the United States? Is tis the same Wendy that possibly lied on her citizenship papers to gain citizenship to the United States? Is this the same Wendy that threatened to sue a newspaper for exposing her when she was a Homestead councilwoman? Is this the same Wendy who held the Holy Bible for BFF Lynda Bell swearing in ceremony? Just asking. If this is the same Wendy no one should be surprise.

What about the recent charges against Ernesto Perez for not disclosing something on legal forms. Oh I forgot, he's a Democratic supporter. Of course he'll go to jail, Lobos won't even have an investigation. My bad.

Miami Dade County is not only Havana North, it's the Tea Party version of picking and choosing who gets which laws enforced against them.

Lobos lied, plain and simple. If they "correct" their forms now it doesn't undue what's been done already nor make donors whole who didn't want to their funds used for a municipal issues, like the Homestead Mayors race.

They all knew better. The Bell workers "allegedly" filling in ballots knew better, now resigned and will skate too like all the others because they're GOPer's and above any and all laws.

Be proud Gimenez, this is happening under your watch when you held a fund raiser for Lynda Bell and attended Mark Bell's fundraiser. You're hands are very dirty in all of this.

The JC Planas letter makes me really go back to the 2010 County Commission race between Flinn and Bell where she won by AB ballots. Didn't the Flinn campaign or one of the PAC's supporting Flinn use JC to review the AB issue back then, did nothing of importance in my opinion because Bell still has her seat and now he's working for this Bell supporting campaign PAC or whatever the legal definition is of this?

WOW!

JC Planas certainly was not enthusiastic about those Absentee Ballots or at the very least, he was ignorant of what he was doing.

The mayor of Homestead is not a county race, but a local race. Papers were filed with the IRS stating "electioneering communications for candidates in county races to promote efficient and ethical government reforms" seem to be different than a local Homestead mayor race.

OMG, even JC's own PAC doesn't disclose Homestead! WTF

Maybe the FL Bar can look at all this stuff since KFR won't and the Fed's are too friendly with her office. I doubt anyone will do anything other then write complaints which go no where. If I had $1 Million I'd go double or nothing on that soon to become fact.

I hope all these people getting involved in a rinky dink Homestead election think this is worth their reputations. is this all just a fun match for you or practice run for the District 8 campaign? Does Lynda Bell really make you all that scared or is it just her ego to get you all to open up your wallets with chump change to pay for this nonsense. Bell needs to go the way of Atlantis.

I thought Wendy lived in Florida City and sat on a public board of some sort in Homestead before she moved to Homestead and because a citizen. That came up during the election debate at Keys Gate country club when she was running for City Council.

It is really cute that the Good Government PAC flyers use the same photo and logo as the bell flyers. To me that is miss representing.

I hate PACs. They corrupt the election law.

Thank you EOM for keeping the spotlight shining on these characters. Even if law enforcement won't.

Planas doesn't understand we the people want to know what the PAC's and ECO's are doing. They should be amended.

Can anyone do anythung about the agreesive Bell supporters that will hardly let people pass through to get in the building to vote in Florida City early voting for Homestead. They did this in the primary to. Ringing those silly bells, really? And Mark Bell out there meeting buses with Haitian voters. Didn't they have to turn away 100 Haitian voters in the primary becasue they weren't from Homestead. The commericals, robo calls, mailers against Porter from the Bell ECO is outrageous. If I were him I would sue them.

I keep my house phone on fax.... :).

You call my cell and I will answer, if I recognize the number.

I hope there are poll watchers in Homestead. If Bell wins I want to see indictments because there needs to be a whole bunch of them.

No one can block entrances or harass voters. If the voters don't have valid ID's they cannot vote or they have to vote provisional.

I will be on watching FL City for the rest of early voting/election day and will be taking pic's if I see any wrongdoing. All others should be doing the same down there and calling the election department writing down what day/time you call and get the name of who you speak with.

Come on Homestead, let's take our elections back from the Bell brigade of Bozo'.

JC Planas represented Fresen in his latest scrape with the Ethics Commission (see results this Friday - Fresen may get off with just a tap on his hand). Can the guy go any lower then Fresen? I guess so if he is tied in with Bell. I guess ya just got to make a living somehow.

Mr. Planas:

The two ECO's might be in compliance with the law but they are not in compliance with the people. We have a right to know what you are raising money for. Why didn't you ammend the ECO purpose so we could know both ECO's were raising money for Mark Bell? We voters have rights too.

At least there is a report, normally in Homestead you go to a fundraiser at the Capri and envelopes of cash are handed over by the good ol' boyz and they are never reported.
2007, 2009 and 2011 this is how it went so I'm pretty sure it is happening again.

Good government now just me another bell mailer today.

People in homestead are still getting new voter cards .... They need to watch for new locations and NO signatures required.

Anonymous said...

Really,in 2007? Do tell, for who ?

Anonymous said...

Think JP and AG in 2007. Both lost.

You are right about the new voter cards. I got a new one today. The polling place changed. I thought they did all this before the voting begins. Some people may be thrown off on election day going to their old polling place. It doesn't matter for me as I mailed my absentee ballot in two weeks ago.
