Jose Smith: Rude Attorney in Miami Beach. By Geniusofdespair

A stream of emails came in to my email. I don't know the context as I don't keep up with Miami Beach politics...but a city attorney should never address a citizen in such a manner, calling someone "delusional" or accuse them of talking "gibberish." I read the whole exchange. The emails that led up to this email didn't warrant an insult. If the guy didn't understand, the Miami Beach City attorney should have taken the time to explain as best he could, or just say, I am sorry I can't help you, I have tried my best. You don't insult someone like this and on an official City email yet! You can think it, Jose, but don't say it.

I know some citizens and gadflies can be VERY frustrating to staff and government officials but if you can't be civil then get a job where you don't deal with the public.  Especially when it is the public that pays your salary.

I don't care about the issue so don't anyone try to explain it to me. I have enough issues to contend with.

Here is the email that was forwarded to me:

From: Smith, Jose (Lead Attorney for Miami Beach)
Date: Fri, Mar 22, 2013 at 2:39 PM
Subject: RE: Quick Question Comm Procedure
To: David Arthur Walters

You are still talking gibberish.

The City Attorney does not “advise” commissioners on how to vote on an ordinance.

The City Attorney’s ONLY “interest” is the best interest of the city.

The City Attorney would recuse himself on ANY matter affecting his private interests.

You, sir, are delusional!

Let me rewrite the email for you Jose Smith:

"Sorry I don't understand your question. If you are saying what I think you are saying,

The City Attorney does not “advise” commissioners on how to vote on an ordinance.

The City Attorney’s ONLY “interest” is the best interest of the city.

The City Attorney would recuse himself on ANY matter affecting his private interests."

Btw, don't bother writing a comment bashing any individual citizen or gadfly. You can of course comment on them as a group. They do deserve respect even if they are annoying.

Jose's an honor student from the Lynda Bell School of Public Relations.

Lynda doesn't know what the word delusional means.

The city manager has a very tough job. Essentially he has to cover for all the departments that messed up. Mistakes that costs half a billion dollars in devalued property values. The full extent of all of Miami Beach's problems will not be disclosed until the insiders collect their final payouts.

The City Attorney for the City of Miami is barely an attorney. She writes "Legal Opinions" and "Legal Memos" that pander to the personal bias of whichever City Commissioner's Campaign Manager's client wants a insider deal.

I have been called a blogger and a citizen journalist but never a gadfly like Socrates. I am flattered, and agree with your assessment while keeping in mind that Mr. Smith is under considerable stress protecting the previous administration during this time of turmoil.
