Get on the Wrong Page with Erik Fresen: Go to His Developer Love-Fest! By Geniusofdespair

Representative Erik Fresen (R-Miami) will be hosting a forum (Wednesday, July 8th at 6:00 pm in the City of Coral Gables Youth Center, 402 University Drive, Coral Gables) regarding Florida’s new growth management laws. Representatives from the development industry - including the Builders Association of South Florida (BASF) and the Latin Builders Association (LBA) - as well as those from local governments will be in attendance.

"I felt it was important to create a forum whereby the development industry, local governments and citizens could discuss what this legislation actually does and how it affects current growth management practices. It's important for everyone to be on the same page" Fresen said. (All of the above is from Fresen press release)

Yep, Erk, we all want to be on the WRONG PAGE with you! No thanks. Erik works on CDMP amendments all the time, i.e. Krome Gold (Rodney Barreto and Sergio Pino). I remember talking to Erik at County Hall when he was working as a lobbyist for Lowe's Big Box Store to move the UDB. This is the wrong guy to host anything but a development love-fest. What an amazing list of bad applications. He may be young but he rolls with the big and not so ethical players. Yeh, he can teach the people a thing or 2 about zoning behind the scenes. People need to attend this meeting in droves or the building industry will say, "We tried to involve the people and nobody came". Then you will hear it coming from commissioners; "Did you attend the meetings?" Of course, if you did not them commissioners have an excuse to dismiss anything the public says.

God help us all…..and this is just the beginning for state Rep. Eric Fresen! He recently held a fundraiser kicking off his bid to be named the Florida Speaker of the House in 2014.

Speaker of the House in 2014; a bit presumptuous since he needs to get re-elected in the 2010 general election. A glance at http://election.dos.state.fl.us/candidate/CanList.asp shows that Erik Fresen currently has no competition for his seat.

I really hate all these girlie men being elected. Who wants a man around who spend more time on his hair than you do?

I think that Erik is dangerous because he is ambitious, pretty and pliable by those with money, which means that we do not rate in the competition for his attention. I do not have a bank account or home large enough to be worthy of his acquaintance.

Interesting that Erik’s last M-D County lobbyist registration was on October 22, 2008 – just prior to his November election to his current State House seat. Could someone educate me as to why Erik’s short but prolific lobbying activity appears to have ceased at this time? Did Erik choose to lower his standard of living and live on a State House salary? Does he continue to lobby in M-D County but is no longer required to register with the County as a lobbyist? Or is he continuing to lobby but violating the County’s lobbying ordinance?

If I’ve quoted the correct legislation, I don’t see any reason why Erik can’t continue to lobby M-D County for additional CDMP changes. Unless he’s appearing in his public office official capacity he should be required to register as a lobbyist in M-D County however. It’s a bit premature to request his financial disclosure for this cycle since he’ll probably use CY ended Dec. 2008 – and he was only elected to his seat in Nov. 2008.
More on Erik: His FL H.R. home page states that he’s a “Land Use Consultant” with a “FSU - B.S in International Affairs and Finance” education. He has an active FL LLC registered to him, “Neighborhood Strategies LLC” with Holland & Knight’s Miami headquarters as the address (Managing member FEFE Corp – no record on Sunbiz). Based on his campaign website he appears to be employed by Holland & Knight as a Public Policy Advisor.
More of lobbying and the FL Statutes: FS 112.313 (7) (a) 2. When the agency referred to is a legislative body and the regulatory power over the business entity resides in another agency, or when the regulatory power which the legislative body exercises over the business entity or agency is strictly through the enactment of laws or ordinances, then employment or a contractual relationship with such business entity by a public officer or employee of a legislative body shall not be prohibited by this subsection or be deemed a conflict. (b) This subsection shall not prohibit a public officer or employee from practicing in a particular profession or occupation when such practice by persons holding such public office or employment is required or permitted by law or ordinance.
More on lobbying in M-D County: Excerpts from the Code of M-D County: Lobbyist" specifically includes the principal as well as any employee whose normal scope of employment includes lobbying activities. The term "Lobbyist" specifically excludes the following persons: attorneys or other representatives retained or employed solely for the purpose of representing individuals, corporations or other entities during publicly noticed quasi-judicial proceedings where the law prohibits exparte communications; expert witnesses who provide only scientific, technical or other specialized information or testimony in public meetings; any person who only appears as a representative of a neighborhood association without compensation or reimbursement for the appearance, whether direct, indirect or contingent, to express support of or opposition to any item; any person who only appears as a representative of a not-for-profit community based organization for the purpose of requesting a grant without special compensation or reimbursement for the appearance; and employees of a principal whose normal scope of employment does not include lobbying activities. …and (3) (a) any public officer, employee, or appointee who only appears in his or her official capacity shall not be required to register as a lobbyist.

Maybe it's legal, but the impression of impropriety leaves a bad taste in the mouth.

As a state rep, he has influence. When he acts as a lobbyist,there's a fine line between his official positions and his professional ones.
