Remember all that golf course stuff going on in Hudstead with Wayne Rosen? Well this guy gets around. Here he is in Former Steve Shiver's 2006 Last Will and Testament, appointed as his Personal Representative and Trustee.  Steve Shiver was Former Opa Locka City Manager, Former Miami Dade County Manager, Former Hudstead Mayor, and Former owner of a cowboy reenactment theme park that went belly-up. I didn't know Steve Shiver and Wayne Rosen were that close. Shiver's will was submitted to the Ethics Department on another matter having to do with Councilman Steve Shelley.

OFF TOPIC, BUT STILL IN SOUTH DADE...

Is the rumor true that Lynda Bell was being considered as Village of Palmetto Bay's Village Manager? Come on. I heard that Councilwoman Karyn Cunningham and Vice Mayor John Dubois were all for it. Could that be true? Not you Karyn, you appeared to be normal when I met you. You are not that stupid....are you?  Anyone know if she is that stupid. I hope this is a rumor because I would be totally turned off to this lady. Bad enough she had Jose Luis Castillo run her campaign. He ran Lynda Bell's campaign too.

Once Jose Luis Castillo runs a campaign for any of these gals (from Palmetto and Cutler Bay he has at least 3 gals in office) they are likes zombies -- under his Svengali-like spell. He ain't looking so good lately packing on the pounds. Maybe that will break the ties that bind. Don't let him exploit you Southern Dade gals in government (he then lobbies them after they are elected). We are watching you all and your votes when he lobbies you.

In Florida's most populous county, one has to search a long, long time ago to find a challenger who defeated an incumbent county commissioner free from criminal indictment or scandal. So congratulations to Daniella Levine Cava: this is an historic moment and breathes hope into Miami-Dade politics and that is a big deal for Florida, too. And because it's Florida, that is a big deal for the nation. That's one reason so much money was poured into the incumbent's campaign, making this the most expensive county commission race in history.

The hard fought win is a victory against the permanent incumbency and by extension the unreformable majority of the Miami-Dade county commission. The Miami Herald misses the point in its headlining the election as a rare show of partisan politics. The organized special interests -- rock miners, FPL, big farmers, developers, lawyers, lobbyists and contractors who rely on county business -- aren't used to losing. (A few did contribute individually to Levine Cava, to hedge their bets.)

In other commission districts where informed citizens despair, Levine Cava's victory shows it IS possible to beat the machine. There is a recipe for success: a credible candidate who represents the public interest and not insiders, a candidate willing to walk every block of their district, a candidate smart enough to draw volunteers in a rational, orderly way and a way to raise enough money to be competitive.

Bell supporters are sore this morning at their narrow defeat. She skulked off without even addressing them last night. But in truth, Levine Cava would have won by double digits but for Bell's decision to bet her entire campaign on a bald faced lie. In terms of dirty politics, Bell's investment in tying her opponent to the highly unpopular deal for the Marlins Stadium ranks at the top. Although the Marlins' deal was highly unpopular, not a single incumbent county commissioner who voted for it has been held accountable at the polls.

One has to stand back and appreciate the audacity of campaign advisors who supported Bell AND the Marlins Stadium: Bell's team knew Levine Cava was strong and authentic and they needed a strong poison to undermine her appeal.

Throughout the campaign, and especially in the final weeks, Bell stuck to the script, she repeated the lie, and invested nearly a million dollars from her contributors to propagate it on television and in serial mailers to district voters.

In a low turnout election, the strategy very nearly worked. Levine Cava was caught off guard. And this is another lesson for prospective challengers: whatever lie the professionals can make stick, they will use it. Every moment Levine Cava spent on defending herself against their poison raised doubts among the uninformed about the key part of her campaign: giving citizens an honest voice on the county commission.

Had Bell lost while running an honest campaign, she might be able to count on a political future. But she didn't and she can't.

Who are the winners and losers? It is a good day for Good Government, for former county commissioner Katy Sorenson who supported Levine Cava quietly at first but increasingly visible in the final weeks, and for Cindy Lerner, mayor of Pinecrest, a smiling, optimistic and battle-scarred survivor of Florida's slash and burn politics. Today will be a very low day for any of the campaign advisors and lobbyists who supported Bell.

From the very start of Levine Cava's campaign, political insiders handicapping the importance of the race understood that District 8 -- because it encompasses the last developable farmland in the county -- was going to be hotly contested but also with the caveat: it is only one of thirteen county commission seats. Some constituencies -- like environmentalists who bore the brunt of Bell's antipathy -- feared supporting Levine Cava because there is still the unreformable majority to "persuade" on critical zoning issues. Some feared retribution and some, perhaps, recall that former county commissioner Katy Sorenson -- when she held the District 8 seat -- was the lone voice of reason on many losing votes. For those doubters, today is a reprieve.

Congratulations to the voters of District 8, and to the supporters, volunteers, and to Daniella Levine Cava.

Two weeks to go, in hotly contested District 8 county commission race … by gimleteye

Last Sunday, "This Week In South Florida" on the local NBC affiliate featured challenger for the District 8 county commission Daniella Levine Cava and the hard-pressed incumbent Lynda Bell. Michael Putney and Glenna Millberg, the co-hosts, conducted the interview as a conversation, but the conversation quickly devolved into talking points.

Although the race is "non-partisan", the subtext was visible: Republican Bell complaining about the unions ganging up and her, and the core values of the GOP: lower taxes and jobs while striking out at Cava who will "have to raise taxes" as a Democratic liberal.

Cava takes the high road: she has been brought forward by a coalition of interests who asked her to run and she will proceed as a county commissioner by first finding ways to cut out the privileges and excesses of the county budget favoring incumbents.

Bell barked at Cava on the Marlins Stadium deal. Liar. Cava charged Bell with demonizing county workers and staff.

The segment -- lasting less than 15 minutes -- proved the inadequacy of television, to get beneath the surface.

On the polish front, Bell presents like a local version of Michele Bachmann or Sarah Palin, both right-wing lightning rods. "This Week In South Florida" co-hosts ought to have asked: have either of you received media training from your respective political parties.

Even the hosts appear discouraged by the result of the medium that employs them.

The segment following Bell and Cava promised insight on the candidates for governor, Charlie Crist and incumbent Rick Scott, and their respective positions on the environment -- since last week was Scott's attempt to lure the environmental vote with the roll out of a new plan to paper over three and a half years of destruction. But once the point was made by the co-hosts' panelists, they simply skipped to the next topic.

It is hard to know what to make of the modern political campaign, filtered through the eyes of experts guessing how the dim public gets its information. Who can say that the billions of dollars being spent to lubricate the American political system through television advertisement is good for Democracy.

That is a question I wished had been asked of the District 8 candidates. I also wish they had been asked about FPL and nuclear power in their area, and why the former director of DERM Carlos Espinosa -- a career civil servant -- resigned after Bell ganged up on him at a "public meeting" called for the purpose of gutting environmental regulations and enforcement.

One of the Worst Things Lynda Bell Did While Mayor of Homestead. By Geniusofdespair.

How did the Sweetwater Mayor get the towing contract in Homestead? The RFP (Portion Above) in Homestead had to be changed (4/8/2009) for it to happen. Lynda was Mayor of Homestead at the time. His business was not in the City limits. It was Lynda's idea to have Homestead change towing companies, out of the blue, in the first place. Was it her idea to add this as well?

Read my previous post November 15th. Something is so fishy with Sweetwater's Mayor (now in jail) and Lynda Bell. Someone has to piece it together.  Someone needs to talk to the previous towing company in Homestead.  It ain't going to be me. Why all of a sudden did Homestead need a new towing company:  Owned by the Mayor of Sweetwater. Doesn't Lynda's daughter work as a cop in Sweetwater after being fired in Homestead for pulling a gun improperly?

County Commissioner District 8 Lynda Bell really deserves a challenger.

Eye On Miami has been tracking the Bell dealings from city hall in Homestead to county hall.

There is, apparently, a backlash against Bell on the county commission -- even among the unreformable majority. The latest, last week, was the rejection of a resolution that would have set a miserable precedent of individual commissioners intervening to carve out exceptions to the law for individual citizens. As amazing as this sounds, the following resolution was actually offered: seeking to exempt certain people from enforcement actions.

What voters in County Commission District 8 need to understand about the economic crisis is this: instead of a turn toward accountability, the entire apparatus of government shifted even further away from accountability.

The Bell resolution is a fine example. Bell -- and the unreformable majority -- have ignored decades of history in the western region of Miami-Dade County known as the 8.5 Square Mile Area. The area is susceptible to flooding. To enable the possibility of re-watering the east Everglades, including within the boundaries of the national park, in the 1980's, plans were crafted to protect the area from development. It didn't stop the worst anti-federal, anti-environmental jihad west of the Rockies from taking place, right in Miami-Dade's backyard.

Over the years, special interests -- mainly big farmers, big developers, and other components of the Growth Machine -- chipped away at every structure built from compromise, political dialogue, and negotiation. At the very end of the line you get exactly what appears: County Commissioner Lynda Bell.

Bell's first initiative, after being elected to office in 2010, was to attack the county environmental resources department. The department is still known as DERM, as if the simple act of articulating the phrase is defiance against the serial assaults against environmental budgets and agency mission. DERM had no defenders -- Mayor Carlos Gimenez gave the whittled down agency a broom closet to work in -- , despite the fact that Miami-Dade County borders some of the most sensitive environmental lands in the nation. That is what we have come to.

That is what we came to, until Lynda Bell.

Today Bell has tried to bully fellow commissioners, as if to channel the spirit and role of Natacha Seijas, the long-serving county commissioner from Hialeah who was recently recalled by voters. But the unreformable majority may not be so willing to simply roll over, the way it did in the boom years when the money, the champagne, the dinners out, the condos and platted subdivisions were flowing as fast as mortgages out of US Century Bank to insiders.

RESOLUTION DIRECTING THE MAYOR OR MAYOR’S DESIGNEE TO REFRAIN FROM FURTHER ENVIRONMENTAL ENFORCEMENT IN THE FEW REMAINING CASES AGAINST PROPERTY OWNERS FOR MULCHED HURRICANE DEBRIS DEPOSITED DURING THE AFTERMATH OF HURRICANE WILMA

WHEREAS, in the aftermath of Hurricane Wilma in 2005, Miami-Dade County was in a state of emergency, there was a great deal of property destruction, and circumstances may have been chaotic; and (BOO HOO on that one, we all went through it we don't get laws sponsored on our behalf) WHEREAS, in this aftermath of Hurricane Wilma, some property owners in the 8.5 square mile area and in the C-9 basin accepted deposits of mulched or shredded hurricane debris onto their properties; and

WHEREAS, in 2012, the Miami-Dade County Wetlands Advisory Task Force recommended that Miami-Dade County provide a one-time resolution for property owners who accepted mulched hurricane debris associated with the 2005 Hurricane Wilma storm season; and (NOTE: THIS WAS A LYNDA BELL ORCHESTRATED TASK FORCE EXCLUDING REPRESENTATIVES FROM ANY ENVIRONMENTAL GROUP). WHEREAS, much of this mulched hurricane debris contained plastics and other trash, along with vegetative debris; and WHEREAS, some of these deposits of mulched hurricane debris constituted environmental violations of Chapter 24 of the Code of Miami-Dade County, including filling wetlands without a permit and improper disposal of solid waste onto properties, and some property owners may not have known that they were violating the law; and

WHEREAS, the Miami-Dade State Attorney’s Office criminally prosecuted contractors who were directly linked to these deposits of mulched hurricane debris onto private property in the aftermath of Hurricane Wilma, and those unscrupulous contractors were forced to pay to clean up the environmental violations linked to them; and WHEREAS, if the contractors who dumped mulched hurricane debris on particular properties could not be found, or if the property owners could not identify which contractor brought them the mulch, Miami-Dade County brought civil environmental enforcement actions in order to clean up those properties and bring them into compliance with Chapter 24 of the Code of Miami-Dade County; and

WHEREAS, now, more than seven years after Hurricane Wilma, there are less than 10 open civil enforcement cases involving property owners who accepted this mulched hurricane debris onto their properties in the aftermath of Hurricane Wilma; and

WHEREAS, recognizing that these particular environmental violations arose during a unique time of emergency and crisis, and in the interest of efficiency, including limited enforcement resources, this Board may wish to direct the Mayor or Mayor’s designee to refrain from further enforcement against the property owners in the few remaining enforcement cases involving said mulched hurricane debris;

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MIAMI-DADE COUNTY, FLORIDA, that the Mayor or Mayor’s designee is hereby directed to refrain from further enforcement against the property owners in the few remaining environmental enforcement actions for deposits of mulched hurricane debris that took place in the aftermath of Hurricane Wilma in 2005. The folio numbers for those nine remaining enforcement actions are listed as follows: 30-5821-000-0153; 30-5815-000-0140; 30-5815-000-1150; 30-5815-000-1610; 30-5828-000-3831; 30-5822-000-0050; 30-5822-000-0112; 30-2911-001-0301; and 30-2913-001-0490. This resolution, however, shall not relieve those property owners from otherwise complying with the Code of Miami-Dade County, including but not limited to the provisions of Chapter 24 and storm water retention regulations.

Lynda: those are not big salaries you are reciting. Instead you should be embarrassed by the SMALL average salary of Miami Dade residents that you mention -- that is what you should be working on. Increasing their salaries. BTW, most of those people rent and don't pay property taxes so raising the taxes won't effect them it will more likely effect the county workers with the $60,000 salaries. Use some logic.

This was a 12 hour meeting. I reduced it to 20 minutes. If you can't even watch that, I don't know what to do to help you readers. I had a hell of a time reducing it and watching it all.

At the same time this was going on we are TALKING ABOUT GIVING PUBLIC LAND TO A SOCCER STAR FOR A STADIUM. Where are the priorities?

County Commissioner Lynda Bell Sucks up to Farmers At the Expense of the Everglades and the Environment and Outright Lies to Voters about it. No Public testimony was allowed.

Petting the monkey, feeding the shark: Lynda Bell -- beleaguered county commissioner facing a tough re-election -- was caught in the commission chamber  pandering to the constituency that most cares about her reign of petty jealousies at the Miami-Dade county commission: wealthy farmers and developers whose main goal is and has always been their own bank accounts. 

It was a sly little move that Bell pulled, a resolution asking for an increase in flood protection in an area where flood protection has already been locked down by special interests, as a state and federal matter. Likely, she was given the task in return for "support" during this last phase of her campaign against challenger Daniella Levine Cava.

EOM guest blogger, Ann Hinga, details the action in Part 2, but here is a quick interpretation.

Miami-Dade's industrial farmers (row crop farmers) and developers pay lip service to the environment. Lynda Bell pays lip service to the environment. The big industrial farmers and Lynda Bell see eye-to-eye.

What they really want is to control regulations: in particular, they want to control whatever flood control measures are implemented by regulatory agencies in state and federal government. When they can't get what they want, their fall back position is to delay, delay, delay.

Big industrial farmers who have taken taxpayers to the cleaners get whatever they want.  What Lynda Bell did the other day is the best example how they do it; the best example taxpayers and voters have had in a long time.  In putting a resolution outside the four day rule, Lynda Bell straight out lied.

She lied when she claimed to have gotten support from the environmentalists. That's utter, complete bullshit. (In fact, it serves the Everglades Foundation right -- that's the one group Bell called out -- they were taken advantage of.  But Bell had reason to believe they would be her patsies because she used the photo op they created for her on a recent Everglades "tour". When she used the photo op to claim her environmental credentials, the Everglades Foundation did not complain. Her thinking: why would they raise a fuss, now?) But they did, they said publicly they did NOT support Lynda's resolution.


The intent of the Bell resolution to INCREASE flood control for farmers shows that the incumbent county commissioner is willing to go to bat for them -- despite the fact they already dominate water supply in South Florida. The flood control for farmers was settled many years ago with the Army Corps and Lynda knows that.

So, yes. This is about politics. It is also as Ann Hinga -- our guest blogger -- points out, about Jim Humble, the South Dade multi-millionaire from the Frog Pond hijacking (another story) -"ringing the Bell" just like reviving the engines at a drag race.

It is also about Bell's colleagues on the county commission. Any one of them could have pulled this item from the county commission agenda because it hadn't been properly noticed within the required time frame. The public could have been given the chance to speak.

Who knows why the county commissioners turned a blind eye: was it ignorance, cowardice, or simply the privilege of incumbency being offered to one of their own, so that when it is time for their own re-election, they can pull similar tricks? (Remember then county commissioner Joe Martinez -- now running for Congress -- and the egg lady from the 8.5 Square Mile Area performance? Check our archive.)

In any case, Lynda Bell was asked to perform, but to perform in a way for her backers in a way that shows a sly disregard for fact, a willingness to toe the line for special interests, and talent for pushing around fellow county commissioners on the dais.  Jim Humble is tickled pink and so are the Miami industrial farmers and developers, too, who are being called upon to support Bell's political campaign.

As for voters in District 8, we expect they will know what to do when their elected representative is caught petting the monkey and when there is a good challenger to do the right thing by them and not for special interests.

As much as I didn't want her elected, I never thought County Commissioner Lynda Bell would be quite this bad so quickly. She is launching a holy war against DERM. She might as well be in bed with FPL as she is kissing their asses. I believe she would like to dismantle the Department of Resource Manangement or clip its wings from managing the fragile environment in Miami Dade. She has launched a misguided resolution based on faulty data about how EPA standards hurt Miami Dade County.
 
Report: STATE ADOPTION OF NUMERIC NUTRIENT STANDARDS (1998‐2008)

page 9 of the report shows a map of all the states that have adopted various levels of numeric nutrient criteria already - the resolution of Lynda Bell (adopted - TO OPPOSE EPA PROPOSED NUMERIC NUTRIENT CRITERIA FOR WATER QUALITY) implies that we're being singled out.  There are at least 18 states with standards already (as of 2008, so there may be more).  Note: At another meeting, she said that if the FDA approved pink slime added to meat, who is she to argue with them, but now that we are dealing with clean water, she feels the EPA is inept. What is it Lynda, regulation that suits you only, saving money at the cost of people's health?

In 1998 The US EPA started a “national strategy” for developing nutrient criteria.  In 2004, FDEP and the US EPA began working on standards for Florida.  In 2008, Environmental groups sued EPA for not moving fast enough.  EPA agreed in 2009 to stop dragging their heels, and finally brought proposed standards to the public in January 2010.  The EPA agreed to delay final implementation of the final rule (adopted November 2010) for 15 months – March 2012.

According to Clean Water Action (and others), implementation / compliance with the standard stretches over 20 years.

These standards only apply to Florida "class 1" (drinking water supply) and "class 3" (fishing, swimming, natural habitat) surface waters.

It applies to those class 1 and 3 lakes, reservoirs, rivers, streams, and springs and explicitly excludes the drainage system of South Florida, meaning that it will have no negative impact on South Florida.  If anything, having sources of pollution cleaned up north of us, means less down-stream pollution to deal with.

Lynda Bell's resolution also repeatedly states that the EPA didn't use "sound science" in determining these standards, when in fact they've taken local concerns into account using reams of data and the final rule allows for variations in geology and soils in setting the standards, allows “site specific alternate criteria” that take unique characteristics of a water body into consideration. DERM was on record saying that there were "disputes over the science" which allowed the notion that it was a "lack" of science in development of the standards.

The University of Florida Agricultural Science division - the folks who run the statewide agricultural extensions - published this report explaining the impact of the standards on the state and basically said that this wouldn't affect agricultural interests already partnering with FDEP through their Best Management Practices and goes into detail about the exemptions for South Florida. The discussions around those standards are starting now.

Deomocratic Fundraiser Brian Goldmeier has questionable scruples raising money for Tea Party Candidates Like Lynda Bell. By Geniusofdespair

Sometimes you have to stand for something bigger than a paycheck. How does it feel to align yourself with the Koch brothers Brian - helping them?

With Gimenez, it was tough at the beginning for Brian,” (Brian) May says. “By the time Gimenez made the runoff, Brian had refined his approach, using a softer touch with donors.”

Goldmeier continued dialing for dollars immediately after Gimenez beat Robaina in the June 2011 run-off. The mayor had a short window to amass another war chest before the next election in August 2012. Common Sense Now collected close to $2 million in a one-year span, mostly due to Goldmeier’s relentless soliciting of campaign donations from people doing business at County Hall.

For his efforts, Gimenez’s political action committee paid Goldmeier’s firm, BYG Strategies, $220,076 in consulting fees, plus a $20,000 bonus. In addition, Goldmeier got another $44,919 from Gimenez’s re-election campaign.

One lobbyist, who asked to remain anonymous, says he disliked Goldmeier from the moment he met him. “I promised Gimenez I would raise a few bucks for him,” the lobbyist says. “That led to Brian calling me every half-hour. The guy’s a jerk, but he is effective.”

Goldmeier has parlayed Gimenez’s victories into more fundraising jobs. Building for Tomorrow, a political action committee organized to promote a successful $1.2 billion bond issue for Miami-Dade Public Schools in 2012, paid BYG $74,507.

During the same election cycle, he pocketed $9,000 in fees from another political action committee that pushed a referendum to expand the Key Biscayne Tennis Center. Goldmeier made $154,046 in fees raising money for last year’s Jackson Memorial Hospital campaign for an extra half penny sales tax. The Miami Dolphins also retained him, doling out $9,000 in consulting fees for a referendum that never happened because the Legislature rejected owner Stephen Ross’ attempt to put public financing of Sun Life Stadium improvements on the ballot.

RACKING UP CONSULTING FEES

Today, Goldmeier is working the phones on behalf of the re-election campaigns of incumbent Miami-Dade county commissioners, Lynda Bell, Jean Monestime and Jose “Pepe” Diaz. So far, Diaz is running unopposed.

Commissioners’ campaign finance reports show that Goldmeier’s firm to date has racked up $43,451 in consulting fees. Political action committees supporting the commissioners have paid BYG another $52,360. He’s mainly been tasked with corralling prominent donors for events featuring Gimenez and politically connected hosts.

For instance, Goldmeier set up an April 2013 fundraiser for Bell hosted by the mayor at the house of Rafael and Vicky Garcia-Toledo. Rafael Garcia-Toledo was Gimenez’s campaign finance chairman and chauffeured the mayor to events during the 2011 special election and the 2012 re-election campaigns. Garcia-Toledo’s wife is a high-powered lobbyist whose clients include Genting Group, the Malaysian casino giant and owner of the old Miami Herald headquarters.

The host committee included some prominent Democrats, such as attorney Alex Heckler, who has raised tens of thousands for the Clintons, and Freddie Balsera, a political consultant who is President Obama’s main pitchman to Hispanics in Florida.
