Senator Alex Diaz de la Portilla's Wife Gets an Order of Protection. By Geniusofdespair

Claudia Davant, wife of State Senator Alex Diaz de la Portilla - Majority (Republican) Leader, was granted a temporary injunction for protection against domestic violence on Friday in Leon County.

She said in her statement:

"My husband is capable of doing anything, including great bodily harm to me, because of the divorce case and criminal investigations in which I am a witness." She also said that he can be "extremely explosive and violent." and that he said that he "isn't scared of the Court or cops, and will finish this his way."

Whoa! I am glad I don't go to Tallahassee much, wouldn't want to tangle with this guy. I wonder how he voted on the Sonogram bill? If what his wife says is true, I don't think he is fond of women right now, so I would venture to say he voted for it.

This guy is exactly what is wrong with the state legislature. Now I hear he is thinking of running for State Representative in District 117. Does he have no shame or dignity. Does he really think that the people in miami are that stupid? WAKE UP MIAMI!!! This guy thinks your seat belongs to him and his family to do with what he wants. Last I checked he does not even live in Miami he lives in Tally.

And his brother Owned-by-developers Miguel DLP is running for state senate, yikes!!!! Have you seen how much money he has raised, and from who? Wow.

By the way, did you see the scary threesome women candidates at the Christian Family Coalition press conference supporting the Sonogram law? Flores running for state senate seat 38, Savola running for state rep seat 115 and Rivas-Logan running for state rep seat 114. It is frightening to think that any of these women are in elected office, and the harm they will continue to do to women's health if they succeed in their political aspirations.

Please Genius, do an article on these three women and how we need to work hard to elect their opponents, not just by being outraged but by contributing to their opponents' campaigns with money, volunteering in their campaigns and getting people to vote on election day.

The injunction is temorary. Anyone can make accusations, and receive a temporary protective order, its done every day. Soon, though, she will have to testify as to the allegations in open court, and present evidence. Just because someone writes something on paper, doesn't mean that its true. Let us see what happens when the matter is brought before the family court in Leon County.

The key here is she is worried about her safety. Given the number of murder/suicides we are experiencing in domestic violence situations, she needs to be extremely careful. Hopefully, because he is a politician, the injunction my keep him from doing physical harm to her. If she doesn't think it will, she needs to disappear for a while. There are programs to help her with her escape.

Again, exactly my point. Talk about pre-judgement... How do you know that she is not lying? Let me spell it out for you, Temporary Protective Orders are granted by the courts based on an affidavit filed by the moving party. The court does not address the veracity of those statements when granting the order. All the judge is doing is confirming that the movant provided information that justified the TEMPORARY Protective Order. There will be a day in open court, where the evidence and testimony will be weighed.

You all have to be kidding me. Talk about knee-jerk reactions. I don't know what the facts are here. The only two that really know are the parties involved. That being said, all you have are allegations from one side at this point. You can't tell me that one possible motivation is knowing that her husband is running for public office, she decided to do whatever she could to ruin him. What is that old saying about a woman scorn?? I would say that it applies equally to men and women, but, the point is that you all should take everything with a large grain of salt, especially in a domestic dispute, without clear evidence to the contrary. Lets see how the court rules on a Permanent Protective Order before we act as judge, jury and executioner...

I think Alex Deserves the benefit of the doubt. Too bad Johnny Cchran ain'yt around he'd have Alex out of this mess faster than you can take of your Bruno Maglia's.

people's personal lives shouldn't be fodder for blog blather. I thought this blog wass important because it hits stories that the conventional news doesn't and seemingly can't.

Forget about these two people for a minute. Lets look at domestic violence in the aggregate. A quick look at daily domestic violence killings reported in newspapers around the country will reveal astounding numbers. Domestic violence is real, not a theoretical concept. In most cases it is men killing women. It cuts across socio-economic status, race, income, educational levels, age, and political stature in a commuity. And in almost every case, the woman underestimated the level of despair and the capability for violence of their husband or significant other. In almost all the cases, had the woman realized it was a toxic relationship and left, she could have saved her life, and in the case of the murder/suicide, his life too. Now lets go back to the present case. Whether it is real or not, the man needs to back off right away. She has told the world she is afraid you will hurt her. Its best to move to another location right away so you will have no contact. Otherwise, one thing leads to another, an argument occurs, emotions take over and someone gets hurt physically. One blow could disable her for life or kill her. No relationship is worth a life.

If you look at her statement in Caputo's blog it specifically mentions her fear of him harming 'their' animals. Why not look a bit further?

New Update on this... As I suspected:

Restraining order lifted in Diaz de la Portillas' messy divorce
Claudia Davant, the estranged wife of Sen. Alex Diaz de la Portilla, on Tuesday dismissed her request for a temporary restraining order against the Miami lawmaker, saying that a hearing on the matter could interfere with a pending FDLE investigation into a separate complaint. Davant had been granted the temporary order to keep Diaz de la Portilla away from her Monroe Street office and the Governor's Club. A hearing on a permanent injunction had been scheduled for Wednesday but the motion to dismiss cancels the hearing.

Diaz de la Portilla's lawyer, Thomas Duggar, said he and his client were disappointed because they looked forward to the hearing in which they had subponaed several witnesses to counter Davant's allegations. "In the end, the truth will prevail,'' Duggar said. "She filed a fraudulent petition that was full of lies.''

Duggar said that neither he nor his client have been contacted by FDLE and consider the investigation to be "a decoy to conceal the truth.''

Here's Davant's statement: "Due to a pending FDLE investigation and upon the advice of my attorney that the previously scheduled hearing could interfere with the FDLE investigation, we are filing a motion to dismiss the Domestic Violence Restraining Order. I will continue to be under the protection of law enforcement and private security for my personal safety as we seek to come to a final divorce settlement quickly and privately."
