Update on the Florida Hometown Democracy Lawsuit. By Geniusofdespair

Federal Judge Kenneth Marra ruled late Tuesday that the venue for the Hometown Democracy lawsuit will be transferred from West Palm Beach to the federal court in Tallahassee.  His ruling is something of a surprise since the Secretary of State has historically been sued in federal courts throughout Florida over election problems.

The Chamber of Commerce must be happy.

Here are Marra's conclusions:
Accordingly, it is hereby ORDERED AND ADJUDGED as follows:
1) Defendant Motion to Dismiss (DE 6) is GRANTED in part and on the basis of
improper venue. It is denied without prejudice with respect to all other arguments
raised in that motion.
2) Plaintiffs’ Motion for Preliminary Injunction (DE 7) is DENIED WITHOUT
PREJUDICE in order that the motion can be heard in the proper forum.
3) Pursuant to 28 U.S.C. § 1406(a), the Clerk shall TRANSFER this case to the
United States District Court for the Northern District of Florida.
4) All other pending motions are DENIED AS MOOT. The Clerk shall CLOSE this case.

The judge didn't want his August vacation disturbed. He also knew the state would gum up the works until November anyway. It's called "representative" democracy.
