Slippery David Rivera Escapes Charges. By Geniusofdespair

U.S. Rep. David Rivera will not be charged locally although that is not to say he didn't do questionable things and there is still hope the FEDs will find something to pin on him. He is up for reelection, can his constituents please vote him out? Miami Dade State Attorney Fernandez Rundle, also up for reelection, is playing it safe. She only charges cat killers and she didn't do a very good job of that one. The Miami Herald reported:

"Although records released late Monday show FDLE last year suspected Rivera of “possible criminal and ethical violations,” ranging from campaign fraud to falsifying financial disclosure forms, prosecutors have concluded that they cannot charge the Miami congressman with any crimes because of ambiguities in the state’s campaign finance laws and a shortened statute of limitations that barred prosecution for expenses more than two years old."

And:

"In a July 2011 memo, FDLE investigators said they believed that Rivera spent as much as $65,000 in campaign funds on personal expenses — from pet care costs to dry cleaning, a dentist’s bill and travel expenses for his girlfriend.”

I'm not surprised! Rundle needs to get reelected too! I think we need term limited on the State Attorney or at least one who actually prosecutes public corruption on the County Level of higher ups & elected officials, not the lower level employees.

He'll be reelected. Even though his opponent has an inside track of the ALF's, I don't believe for one second she'd use those for AB votes, though, we'll see what happens in November!

This State Attorney needs to go!!! Somebody who can't prosecute Rivera or Spence-Jones (or Pepe or ...) is totally incompetent.

Stop being so paranoid. The Florida Legislature wrote a crappy law and Fernandez-Rundle had to choose whether to try to prosecute under it. She did her job knowing that she couldn't prove a crime beyond a reasonable doubt. In that case, it would be unethical to charge a defendant with a crime.

As for Rivera, there is still the IRS/FBI investigation into the Flagler Dog Track matter. However, I wouldn't hold your breath. Unless Rivera's mother cracks, the Feds will be left with little.

In addition, once qualifying ends, the US Attorney will hesitate to bring a charge that smacks of politics. Instead, he will likely wait until the after the election, if charges are going to be brought.

If the readers here want Rivera out of Congress, organize and start volunteering. Just make sure to tell Rivera's opponent not to run the same crappy campaign that Joe Garcia ran in 2010.
