County Commissioner Joe Martinez is Running for Mayor. By Geniusofdespair

Joe Martinez officially filed his papers to run for County Mayor on January 25th. All I can say is Ugh! Actually I am happy that little Joe is running because it is a RESIGN TO RUN position. He will have to resign his commission seat. On that I say Hallelujah, Praise the Lord! That joy is, of course, based on him losing the mayoral election.

I would never support Joe for Mayor, unless he wanted to pay me. I don't think he has a chance, Gimenez is sooo much better. But Joe has the ego to believe he can do it.

I took this picture of Joe at Mayor Gimenez's swearing in. Commissioner Martinez was so excited at seeing all his lobbyist buddies, he was in a frenzy, hopping about the room greeting all the men in suits.... it was as if he were in ecstasy. We all know his ecstasy wasn't about the Mayor being sworn in.

I thought he was more like a dog in heat at the swearing in. I thought he was too jubilant for a man he is now trying to replace. He was busy glad-handing power brokers, happy to have them all in one room.

Apparently you are NOT familiar with Joe the bully. We have 93 Blogs on him. Carlos Gimenez was NEVER a member of what we have called the "unreformable majority" since Gimleteye coined that phrase. Joe Martinez is a charter member...never giving us a decent vote on our issues. He votes with Pepe Diaz, Bruno Barreiro and Barbara Jordan, the worst offenders. Gimenez didn't when he was commissioner.

Proud. He has shapped his district and his position
masterfully. Like any megalomaniac, he really has
no objective view of himself. And, thanks to
his cockeyed view of himself, he will be off of the
Commission. Praise The Lord. He has about as
much chance of being mayor as the Dophin's
Mascot, who might have a better chance. Who's going
to pay for his future housing needs now? Watch how
his "friends" disappear. I hope he has some nice
lap dogs to keep him company.

The resignation must be submitted in writing at least 10 days prior to the first day of qualifying for the office the person intends to seek. (Section 99.012(3)(c), Florida Statutes.) (The qualifying dates for elections to particular offices can be obtained from the county supervisor of elections office.)

The resignation must take effect no later than the earlier of the following dates:

The date the officer would take office, if elected; or
The date the officer's successor is required to take office.

Don't get your hopes up he has till
8 a.m., Tuesday, May 22, 2012 through Noon, Tuesday, June 5, 2012
to drop out....without resigning

Why all the hatred against Martinez? Have you bothered to check out all the heavy hitters who are contributing and banking on Gimenez' coronation? Are you not aware of his Quarter Million Dollar Club, the disastrous mergers of unrelated departments for future privatization and his plans to do away with the county as a whole through incorporation? How much more will you have to pay when you are left at the mercy of a small city and companies such as Waste Management? Look at the issues and please, refrain from demeaning the man based on his height.

He would have to resign By May 12th. There are no term limits. He has to resign.

No his current term as commissioner doesn't overlap with the next term of mayor. So resign to run doesn't apply.

I believe he has to resign upon qualifying which runs through June 5th.

I beg to differ. I went to the resign to run hearing of Eugene Flinn. He was deemed okay because he was term-limited. It is a sticky point but if Martinez doesn't want to be challenged he will resign to run.

He has to run 10 days before qualifying starts which is May 22nd.

The suggestion that an incumbent whose term is not concurrent with the election of a Mayor does not have to resign to run is wrong. Notwithstanding the flawed assertion, Commissioner Martinez is up for election this year. All of the odd numbered districts stand for election in 2012, and he is district 11.

Mayor Flinn's situation was different. The palmetto bay charter provided that if a runoff was needed in his successor's election he would need to remain in office past the date of the start of the commission seat he was seeking. Thus there was the possibility that the terms of office would overlap. This does not exist in the county charter and thus doesn't apply here.

Oh for the love of God... Who the hell cares anymore. Let him not resign. You are all grasping at straws for no reason. To be safe he will resign 10 days prior if he is serious. He wouldn't chance trying to tie his wagon on a legal loophole. Palmetto Bay has a charter too that had timelines. Go read the transcript .

What does the “resign-to-run” law state?
The “resign-to-run law” essentially prohibits an elected or appointed “officer” from qualifying as a candidate for another state, district, county or municipal public office if the terms or any part of the terms overlap with each other if the person did not resign from the office the person presently holds. (Section 99.012(3), Florida Statutes.)

What if their is a recount in the district 11 commission seat and legal challenges and the mayor swearing in happens before the challenges are resolved. Martinez would be fucked.

I have always thought that the so-called "resign-to-run" law was not properly written. Its intent is not clear how it should or should not be applied.

Why is there a surprise?

Those writing the laws are legislators who have allegiance to their counterparts in local government and, for the rest of us, this law was written to accommodate their less than fair advantage against anyone wanting to run for office who is not one of them.

In fact, I have noticed that many state laws in Florida are very loosely written and many are so broad as to beckon substantial amending. There are many buzz words used in writing laws that make them either strong or weak and many times when I am reading a law in Florida, the determinate words follow a distinct pattern of omission.

But that is how they do it to protect themselves and their cronies, leaving them wiggle room to interpret the law however it suits them. How can we change this? Let's not even go there!

I believe Joe will win. Elections in MDC are never about who the voter want to support...it's always about voting against the other guy. Unless Braman gets the voters all in a frenzy to support Gimenez the only organized voter block will be the County employees who hate Gimenez. Without someone to lead County voters to the polls there will be the usual low turnout. Also don't underestimate Martinez he is a pussycat compared to the arrogant vile behavior that Gimenez displays. Unlike Gimenez, Joe knows how to play with the other kids in the sandbox.

The end result is: He will not be able to be on the August Ballot in 2 different places (under Mayoral Candidates or Commission District 11 Candidates). So he'll have to pick one.
